{"id":15608,"date":"2026-06-08T11:40:31","date_gmt":"2026-06-08T18:40:31","guid":{"rendered":"https:\/\/fnfa.ca\/?page_id=15608"},"modified":"2026-06-08T11:40:33","modified_gmt":"2026-06-08T18:40:33","slug":"surety-and-bonding","status":"publish","type":"page","link":"https:\/\/fnfa.ca\/en\/surety-and-bonding\/","title":{"rendered":"Surety and Bonding"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Addressing the Lack of Access to <strong>Surety<\/strong><\/strong> <strong>and Bonding: \u00a0Releasing the Untapped Potential of First Nations Contractors<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Situation<\/h3>\n\n\n<div class=\"row cntBlock col2block fullimg\" id=\"col2block-block_fc8e0f937a59452ad97f4bc2b1256091\">\n\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t\t\t\t\t<p>First Nation contractors with assets on reserve continue to face legislative barriers which <strong>prevent them from signing an enforceable indemnity agreement which is mandatory to obtain the surety and bonding insurance required for bidding on virtually all construction projects.<\/strong><\/p>\n<p>First Nations Finance Authority (FNFA) has called upon Canada to establish a backstop fund to provide a pathway for First Nations contractors to sign indemnity agreements. Change is needed now to ensure that First Nations contractors are prepared to participate in the move to close the growing infrastructure gap, currently quantified at $350 billion. Furthermore, this change is needed to ensure First Nations contractors who are located on reserve can participate in economic opportunities arising in their territories as part of Canada\u2019s \u201cbuild agenda\u201d.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t<div class=\"colImg\"><img decoding=\"async\" src=\"https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/fnfa-construction-worker.webp\" alt=\"\" \/><\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t<\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Complication: Why is a Backstop Needed for First Nation Contractors?<\/h3>\n\n\n<div class=\"row cntBlock col2block fullimg\" id=\"col2block-block_ab4c259be9ea914257adca50e34c3b7b\">\n\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t\t\t\t\t<p><em><strong>89 (1)<\/strong> Subject to this Act, the real and personal property of an Indian or a band situated on a reserve is not subject to charge, pledge, mortgage, attachment, levy, seizure, distress or execution in favour or at the instance of any person other than an Indian or a band.<\/em><\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t\t\t\t\t<p>Without collateral, First Nations contractors, with assets located on reserve, cannot sign an enforceable indemnity agreement; without indemnity agreements, they cannot obtain surety and bonding insurance, a prerequisite for virtually all major housing, infrastructure, and resource projects. The result is predictable: First Nation contractors are often pushed into subcontractor roles, unnecessary joint-ventures or excluded entirely from the bidding process.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t<\/div>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img decoding=\"async\" width=\"1823\" height=\"1022\" src=\"https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue.webp\" alt=\"\" class=\"wp-image-15712\" srcset=\"https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue.webp 1823w, https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue-300x168.webp 300w, https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue-1024x574.webp 1024w, https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue-768x431.webp 768w, https:\/\/fnfa.ca\/wp-content\/uploads\/2026\/06\/indian-act-section-89-issue-1536x861.webp 1536w\" sizes=\"(max-width: 1823px) 100vw, 1823px\" \/><\/figure>\n<\/div>\n\n\n<h3 class=\"wp-block-heading\">Proposed Solution<\/h3>\n\n\n<div class=\"row cntBlock col2block\" id=\"col2block-block_27d5989e7150d181302e26ededd145cd\">\n\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t\t\t\t\t<ul class=\"wp-block-list\">\n<li>Canada\u2019s 2025-2026 budget announced its intention to explore the creation of a surety and bonding backstop pilot project for First Nations contractors on reserve to enable on-reserve construction companies to bid for infrastructure projects.\u200b<\/li>\n<li>FNFA has established a technical working group to co-develop this pilot with involvement from other subject matter experts.<\/li>\n<\/ul>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"col-12 col-lg-6\">\n\t\t\t\t\t\t\t\t\t\t\t\t<ul>\n<li>FNFA has proposed the establishment of a renewable backstop consisting of funds that can be leveraged to enable the signing of an enforceable indemnity agreement, allowing First Nation contractors to compete for contract bids. If selected as the proponent, then upon successful completion of the contracted job, the leveraged backstop funds would be released and recycled to another contractor interested in bidding on a different project. The long term intended objective is a national rollout in which this model will be made available to all First Nations contractors with assets on reserve who face this barrier.
